Update on Hungary, April 2023
05 April 2023Heidelberg Materials’ reaction to changes in the law in Hungary received attention this week in the German press. The government introduced its Act on Hungarian Architecture in March 2023 that will enable it to set production levels and prices upon foreign-owned cement producers when the new legislation takes force in July 2023. An unnamed executive at the Germany-based Heidelberg Materials told Der Spiegel that, "These regulations represent a complete violation of all rules of the European single market.” They added that the Hungarian government appeared to be trying to force the producer to sell up. The report further alleges that the owners of Duna-Dráva Cement, Heidelberg Materials and Schwenk Zement, also received an offer to buy them out in mid-2022 from an individual with links to Prime Minister Victor Orbán.
This latest move to corral the cement sector in Hungary follows a number of recent changes in legislation. Notably, Decree 404 was introduced in July 2021. This set a 90% tax on the ‘excess’ profits of cement, plaster, chalk, gravel, sand, clay, lime and gypsum producers with the stated intention of wanting to prevent rising prices. The government set a threshold price for cement of Euro56/t at the time. At the same time it also blocked exports of cement and other raw materials of declared strategic importance unless affected companies had registered with the Ministry of the Interior. The European Commission (EC) responded to a parliamentary question on the matter in November 2021 saying that it had sent a formal letter to Hungary informing it that it was breaching some parts of the Treaty on the Functioning of the European Union (EU) on the free movement of goods. Although it noted that the new law also affected exports outside the EU, which was beyond the EC's remit. It added that the so-called ‘mining royalties’ did not seem to breach EU tax law.
Concerns over these issues between Hungary and Germany also surfaced in October 2022 when Orbán met with the German Chancellor Olaf Scholz. At this time Thomas Spannagl, the head of Schwenk Zement, said that the windfall profit tax in Hungary had a "serious negative" impact on business and that importers were not affected in the same way.
Heidelberg Materials’ subsidiary Duna-Dráva Cement is the largest cement producer by production capacity in Hungary with two integrated plants at Beremend and Vác. Together they have a production capacity of 2.8Mt/yr, according to the Global Cement Directory 2023, or about 70% of the country’s active national capacity. Heidelberg Materials reported that its result from equity accounted investments fell by 27% year-on-year to Euro262m in 2022 from Euro356m in 2023 due to a decline in earnings particularly in China and Hungary. This compares to a 4% drop to Euro3.74bn in its result from current operations before depreciation and amortisation across the whole business. Despite this it also noted that Hungary’s overall economic output had grown by 5% in 2022.
Just before the new laws affecting cement companies starting arriving in mid-July 2021, the Hungarian Competition Authority started an investigation into a “drastic” increase in raw material prices. This followed a warning a year earlier in 2020 that it had started competition supervision proceedings against the three main market participants: Duna-Dráva Cement, Lafarge Cement and CRH. All three are foreign-owned companies.
Lafarge Cement Hungary operates the Kiralyegyháza plant and it is due to change its name to Holcim in May 2023. Its predecessor companies, Holcim and Lafarge, also used to run plants at Hejocsaba and Lábatlan before the merger in 2015. However, the Hejocsaba plant ran into legal problems between Holcim and another investor, shut in 2011 and was later forcibly taken over by the other party in 2014. Today the plant operates as Hejőcsabai Cement- és Mészipari (HCM) but cement production is reportedly yet to restart nearly a decade later and Holcim says that legal proceedings are still ongoing. The Lábatlan plant, meanwhile, closed for good in the early 2010s. CRH took over some of Holcim’s other operations in Hungary in 2015 at the same time as the formation of LafargeHolcim but does not run any cement plants in the country at present. It does own cement plants in nearby countries that are able to supply the Hungarian market as well as running 19 concrete units. It describes itself as the “number two player” in the local market. It wasn’t specific on Hungary in its financial results for 2022 but it did describe sales in its Europe East region as being ahead of 2021, “due to a strong focus on commercial actions to offset significant cost inflation.”
Construction costs in Hungary do appear to have grown faster than other European countries in the second half of 2021 as the country came out of the coronavirus pandemic. However, the country's anti-immigrant labour stance may have also contributed to the situation, in addition to the high-energy prices and supply chain bottlenecks experienced elsewhere. In addition, cement companies are also capable of monopolistic behaviour. For example, Duna-Dráva Cement’s proposed acquisition of Cemex Croatia was blocked by the EC back in 2017 on competition grounds. However, given how international the cement industry has become, it is surprising to see this kind of treatment from a government within the European Union.
Belgium: Cembureau, the European cement association, has warned against a proposed 2041 phase-out date for industrial CO2 in the Commission draft Delegated Act on renewable fuels of non-biological origin (RFNBOs). The European Commission’s (EC) draft Delegated Act on the greenhouse gas saving criteria for RFNBOs sets the rules under which such fuels can qualify as sustainable. The European Commission considers that CO2 from industrial sources should not be allowed for the production of synthetic fuels as of 2041, as this would go against the objective of carbon neutrality by 2050.
Koen Coppenholle, the chief executive officer of Cembureau, said “By proposing an arbitrary deadline on the use of industrial CO2, the EC severely restricts the deployment of carbon capture and utilisation (CCU) in the cement sector.” He continued “We regret that this phase-out date was established without a thorough impact assessment. This risks negatively impacting several on-going carbon capture projects in the European Union (EU), at a time of a global race for green investments.” Coppenholle also called for a “real, thorough debate on CO2 utilisation” to ensure that EU policies support CCU and the deployment of CO2 transport infrastructure and storage.
The association is objecting against this proposal because in its view: manufacturing synthetic fuels using industrial CO2 make a “decisive” contribution to climate mitigation in the short to medium term; no impact assessment has been presented by the EC; the delegated act threatens the viability of existing CCU projects in the cement sector, which require a payback time of 30 - 35 years; and the Delegated Act does not recognise the reality of industrial installations like cement plants, which are faced with unavoidable CO2 emissions, and may not have access to CO2 geological storage sites.
The Delegated Act will be passed to the European Parliament and Council for further scrutiny until April 2023 whereupon they will either accept to reject the proposals. The scrutiny period can be extended to June 2023 at the request of either body.
Aker Carbon Capture appointed for Finnsementti's Lappeenranta cement plant installation
31 January 2023Finland: Finnsementti and energy provider St1 have selected Norway-based Aker Carbon Capture to carry out a pre-engineering study for a planned carbon capture system at the cement producer's Lappeenranta cement plant in South Karelia. Dow Jones Institutional News has reported that Aker Carbon Capture offers a 40,000t/yr carbon capture system, capable of producing 25,000t/yr of methanol for use as transport fuel. The project is scheduled to deliver commercial synthetic methanol by 2026.
The Lappeenranta cement plant carbon capture project recently received Euro35.4m in additional funding from the Finnish government, subject to European Commission approval.
Titan Cement Group’s H2CEM green hydrogen project included in EU Hy2Use initiative
27 September 2022Greece: Titan Cement Group says that its H2CEM green hydrogen projection has received inclusion under the EU Important Project of Common European Interest (IPCEI) Hy2Use. Hy2Use consolidates funding for hydrogen electrolysis, transport and storage development projects across Europe. Titan Cement Group’s H2CEM project consists of Euro60m-worth of new green hydrogen production installations at its Drepano, Efkarpia and Kamari cement plants. The installations will produce hydrogen through electrolysis using renewable energy sources. The producer says that use of the hydrogen as cement fuel will reduce the plants’ CO2 emissions per tonne of cement by 8%, corresponding to 160,000t/yr of emissions. H2CEM is Hy2Use’s only cement plant project.
Titan Cement Group aims to achieve carbon neutrality by 2050.
Denmark: FLSmidth says it will lead CO2Valorize, a new consortium intended to develop and deploy carbonation technologies in the cement industry. The group will receive Euro2m from the Marie Skłodowska-Curie Doctoral Networks and is supported by the European Commission’s Horizon Europe initiative. The expected commercial and technical outcomes of the consortium include a full flow sheet of the carbonation process line, the techno-economic analysis of various technology and materials options, and the optimisation of FLSmidth's proprietary reactors. The project is also intended to be a key part of FLSmidth MissionZero programme.
Burcin Temel McKenna, Head of Green Cement Solutions Development at FLSmidth, said “We have been granted a unique opportunity to revolutionise the cement industry at a time of extreme urgency”. He added, “On-site carbon capture and utilisation projects will be a quicker and more economically viable way forward for in cement plants.”
The consortium includes the following partners: Norwegian University of Science and Technology; Karlsruhe Institute of Technology; HZDR Innovation with Helmholtz-Zentrum Dresden-Rossendorf and Technische Universität Dresden; Technical University of Denmark; University of Padova; Siemens Process Systems Engineering; and the Slovakia-based cement producer Cemmac. The partners will support eight fully funded PhD students conducting research into the characterisation and kinetics of carbonated materials and optimisation of the carbonation process. They will also explore the commercial opportunities for mineral carbonation. The focus will be on the carbonation of calcium-, aluminium-, and magnesium-silicates as well as cement derivatives, slag, fly ash, recycled concrete fines and mine tailings.
France: Lhoist and Air Liquide have signed a memorandum of understanding with the aim to build a carbon capture unit at Lhoist’s Réty lime plant in Hauts-de-France. Air Liquide wants to build and operate a unit from 2028 using its Cryocap FG (Flue Gas) technology to capture and purify 95% of the lime plant’s CO2 emissions. The companies have jointly applied for the European Innovation Fund large scale support scheme to pay for the project. This partnership is a step towards the creation of a low-carbon industrial ecosystem in the Dunkirk area.
Lhoist’s ‘Chaux et Dolomies du Boulonnais’ plant in Réty is France’s largest lime production plant. A potential carbon capture unit at the plant could potentially reduce the CO2 emissions of the plant by more than 600,000t/yr. Captured CO2 would then be transported to a multimodal CO2 export hub in Dunkirk, currently under development, and sent to be sequestered in the North Sea as part of the D’Artagnan project, which has received the PCI (Project of Common Interest) label from the European Commission. The implementation of the project will be possible as public funding from European and/or French schemes supporting decarbonisation become available.
Eqiom secures European Commission Innovation Fund funding for Lumbres cement plant upgrade
04 April 2022France: The European Commission (EC) has awarded funding under its Innovation Fund 2021 for CRH subsidiary Eqiom’s upgrade to its Lumbres, Hauts-de-France, cement plant. The work includes the replacement of a kiln and the installation of a carbon capture, utilisation and storage (CCUS) system at the plant, in collaboration with Air Liquide. The producer says that the project is one of seven selected under the EC’s K6 programme of innovation funding in line with the EU Green Deal.
Balearic Environmental Commission tightens requirements on Cemex’s Lloseta cement plant’s licence
18 June 2021Spain: The Balearic Environmental Commission has set more stringent environmental requirements than previously in its authorisation of Cemex’s Lloseta plant’s licence to operate. The Diario de Mallorca newspaper has reported that the authority has followed standards set out by European Commission decisions. The requirements cover emissions, dust and hazardous waste volumes.
Trade versus climate on the edge of the EU
09 June 2021Little trickles of detail about the European Union’s (EU) proposed carbon border adjustment mechanism (CBAM) started to emerge last week. The key bit of information that Bloomberg managed to squeeze out of their source was that a transition period with a simplified system is being considered from 2023 and then a full version could turn up in 2026. Cement importers, and those in selected other heavy industries, would be required to buy electronic emission certificates at prices corresponding to those in the EU emissions trading scheme (ETS). Other titbits include: that the prices will be set on a weekly basis based on the average carbon permit price within the EU that week; a default value will be devised for importers who can’t back up their emissions data; and imports from a country with its own carbon pricing scheme will be entitled to a discount. The plans are due to be made public in mid-July 2021. Debate is then expected to follow before approval will be required from the European Parliament and member states.
The detail isn’t out there yet but the CBAM is set to collide with trade agreement territory. For example, how the draft agreement tackles issues such as exports from Europe and whether importers should be compensated for not receiving a free allocation of carbon credits could be seen to offer competitive advantage to one party or another. Climate policy will clash with trade policy once or if the CBAM makes in into law. At this point countries that import cement into the EU may start trying to negotiate or complaining to the World Trade Organisation. One previous example of climate policy bashing into trade agreements is when the EU tried and failed to apply the ETS to aviation in the early 2010s. The experience from this incident is expected to inform the European Commission’s approach on the CBAM.
Outside the EU, new carbon pricing schemes have been popping up all over the place and various cement associations are creating or refining their own carbon neutral plans. Last week in North America, for example, the Cement Association of Canada said it was working with the government on launching a roadmap by the end of 2021. In the US, the Portland Cement Association (PCA) has also been hard at work to publish its own roadmap by the end of 2021. Meanwhile, over in the oil sector there were a couple of victories for activist shareholders in May 2021 with Shell, Exxon Mobil and Chevron all being forced to make changes to their climate change polices by courts and activist investors. This makes one wonder how long it will be before the same thing happens to cement companies.
All this increases the pressure between trading agreements and climate legislation. One of the questions that has popped up at Global Cement’s webinar series has been whether attendees thought that a global carbon pricing and/or trading scheme might be a realistic position or not (the majority said ‘yes’ within 20 years). Yet the EU CBAM, all these sustainability plans and continued pressure by investor activist don’t happen in isolation. They occur in an interconnected world.
So it was both non-surprising and eye-popping to discover recently that a private carbon exchange is being prepared in Singapore for a launch by the end of 2021. Climate Impact X (CIX) is being backed by DBS Bank, Singapore Exchange, Standard Chartered and the Singapore-government owned investment company Temasek. As for which companies would actually voluntarily enter into a scheme that would actively reduce profits, the answer lies above. Any organisation looking to trade between carbon pricing jurisdictions might well have an economic incentive to find a truly international scheme that was reputable. Or, perhaps, a publicly owned company dealing in carbon-intensive products might be bullied into one by its activist investors. The focus on such an exchange being reputable is essential here, given the potentially large amounts of money that could be involved and the mixed views on existing carbon offsetting schemes. CIX says it will use satellite monitoring, machine learning and blockchain technology to ensure the integrity of its carbon credits and this is certainly thinking in the right direction. Until it arrives though, we wait to see the detail on the EU CBAM.
European Commission to introduce carbon border adjustment mechanism for cement imports from 2023
07 June 2021EU: The European Commission is reportedly planning to introduce its carbon border adjustment mechanism (CBAM) for cement imports from 2023. Reporting by Bloomberg has revealed that a ‘simplified’ system could be used in a transition period from 2023 with the full mechanism due to start in 2026. Under the new system, cement importers would have to buy certificates at a price linked to the European Union (EU) emissions trading system (ETS). Details on the CBAM and wider environmental plans are due to be made public in mid-July 2021. However, full legal acceptance of the scheme will require approval by the European Parliament and member states.
In a previous response to a report on the CBAM in February 2021, Koen Coppenholle, the head of the European Cement Association (Cembureau), said that a CBAM was a useful tool to address the imports of products not subject to similar carbon constraints in the European Union. He added, “The Environment Committee’s report highlights some key points in this respect, notably that a CBAM should result in EU and non-EU suppliers competing on the same CO2 costs basis; that the scope of CBAM should be wide to avoid market distortions, and that both direct and indirect emissions should be included.”
In May 2021 the EU ETS reached a price of Euro50/t following a significant rise from late 2020 onwards.
